ONLINE TERMS AND CONDITIONS

 

http://shop.ra13.be (‘RA SHOP’) is the site for e-commerce of RA BVBA (hereunder further referred to as RA SHOP) having its registered offices at Kloosterstraat 13 in 2000 Antwerp, Belgium. The activities of RA SHOP are categorized as ‘sales on distances’ as defined in the Belgian Law on Market Practices and the Protection of Consumers dated 6th April 2010. By placing an order with RA SHOP you expressly acknowledge to have read, to have fully understood and to have agreed upon the Terms and Conditions provided hereunder.

 

 

 

CONFIRMATION

By clicking on the ‘confirm’ button after having placed your order, you hereby expressly and without any reservation accept this confirmation as well as the entirety of these General Terms and Conditions of Sale.

The data recorded by RA SHOP constitute the full proof of the transactions passed between RA SHOP and its customers.

The data recorded by the system of payment constitute the full proof of the financial transactions.

RA SHOP offers its products at ‘shop.ra13.be’ until these products are sold out. RA SHOP cannot be held liable for any damages or losses caused or incurred by the being out of stock of the ordered product.

 

 

CANCELLATION

Once your order has been confirmed, it is possible for you to cancel an order, without fines and without the necessity to give a reason for this cancellation, within 14 calendar days after the date of delivery of the goods and to receive a full refund of the paid retail price.

If, at the time of cancellation [via an e-mail to shop@ra.13,be], the goods have left RA SHOP, the customer shall be held accountable for all further delivery costs to return the goods to RA SHOP, in order to obtain a refund of the paid retail price, excluding delivery costs.

If the goods have not yet been shipped, the customer will receive a full refund of the paid retail price and the specified delivery costs.

Discount goods will be refunded with a voucher the amount of which will be deducted from a next online purchase or order.

 

PAYMENT METHOD

RA SHOP accepts payment for the ordered goods in Euros (€) via http://paypal.com (‘PAYPAL’) on the RA SHOP site. PAYPAL accepts funds via VISA, AMERICAN EXPRESS and MASTERCARD, or payment directly from the customer’s own PAYPAL account.

 

 

DELIVERY

RA SHOP commits itself to send the ordered goods to you within 7 days after the conclusion of the transaction on the condition that the ordered goods are in stock.

If the ordered goods are out of stock, you will be informed immediately by e-mail from shop@ra13.be. 

This does not however cancel the transaction if RA SHOP is able to re-order the goods at a later date and this later date is indicated in the information mentioned above about the being out of stock of the ordered goods.

 

 

EXCHANGE

If you are not satisfied with the goods delivered to you, RA SHOP commits itself to exchange the ordered goods or to refund the paid retail price.

You have 14 days from the date of delivery of the goods to return the products in the original packing.

If you want to return undamaged or complete goods, the delivery cost will be payable by you.

- Products from the vintage section cannot be returned or exchanged.

- Sale items may not be returned or exchanged - Perfumes may not be returned or exchanged

- Bathing suits and underwear may not be returned or exchanged

- Broken, incomplete or used goods may not be returned or exchanged, or will be returned to you and the costs of shipping will be payable by you.

- opened electronic goods may not be returned or exchanged.

 

FAULTS

In case of damages or losses to the purchased goods constituting visible defaults/vices, the customer shall inform RA SHOP within 3 working days after the receipt of the goods via e-mail to shop@ra13.be. Damages to the packaging of the goods will not be considered as a default/vice.

No complaint will be accepted of the purchased goods have been manipulated or altered by a third party, with the exception of the actual carrier of the goods.

With regard to hidden defaults the provisions of articles 1641 and following of the Belgian Civil Code will be applicable.

 

 

LEGAL GUARANTEE

You will have the advantage of the legal guarantee for every fault in compliance that exists 

at the delivery of the goods, on the condition that you did not have knowledge of the fault or had to have knowledge of the fault at the moment of conclusion of the transaction and if this fault demonstrates itself within a term of two (2) years as from the mentioned delivery. In this event you can claim the repair or the exchange, and, if none of these mentioned solutions is possible, claim an appropriate decrease of the price or the annulment of the agreement pursuant to the legal provisions provided for in article 1649bis and following of the Belgian Civil Code.

In view of this you will have to inform RA SHOP in writing the latest within two (2) months after the moment you have assessed the fault. If the fault demonstrates itself within a term of six (6) months from the date of delivery, it is up to RA SHOP to prove that the fault did not exist at the delivery. After the term of two (2) you have no right to claim the repair or exchange of the goods. Goods that have a normal life span of less than two years, or even six months, in accordance with general common usage or the state of the technique (and taking into consideration their price) are only guaranteed for their normal life span. 

 

 

DELAYS

If the customer has not received the goods two weeks after payment, the customer will inform RA SHOP of this delay by e-mail to shop@ra13.be.

RA SHOP cannot be held liable for the delay in delivery of the goods if the information of delay is not given within the mentioned two weeks after payment.

 

PRICES

All prices of the goods in the RA SHOP are given in Euros (€) and are presented inclusive of Belgian VAT at the current rate of 21%.

This will be indicated on your order confirmation and is itemized in the order and at the ‘checkout’ page on the RA SHOP site.

If your order has to be dispatched to a destination outside the European Union (EU) this VAT will be deducted at the ‘checkout’ page and this deduction will be shown on your invoice.

If your order has to be dispatched to a country that is a member of the EU then the total price will include VAT at the current rate of 21%.

It is to be noted that RA SHOP has no control over any customs or import duties that could be levied when the goods reach the country to which the goods have to be dispatched and RA SHOP can not be held liable for the levied customs or import duties.

 

TRANSPORT

The purchased goods will only be delivered to you after receipt of the full payment of the balance of the amount due. 

All goods will be shipped by DHL Express and will be insured by DHL Express if you select to pay for this option of insurance.

Delivery costs are calculated by weight and volumetric weight, whichever exceeds the other.

When RA SHOP has received your order and processes the sending of the goods, RA HOP will inform you via e-mail of the number corresponding to the dispatched goods. 

All customs charges incurred are the responsibility of the customer.

In the event of loss, deterioration of or damages to the dispatched goods during the transport, the customer will have to inform the carrier company immediately.

 

 

APPLICABLE LAW AND JURISDICTION.

 

This transaction is considered to be made up in the RA SHOP registered offices.

The contractual relations between the parties resulting out of this transaction is construed and will be governed by Belgian law.

Any dispute regarding the execution, performance and interpretation of this transaction will be of the exclusive competence of the Courts of Antwerp.
